The person selling the house has to sign a form stating that to his knowledge a variety of conditions (including mould) are not the case.
And if you’re unsure? Ask the seller or realtor – they’re commiting fraud if they lie.
But regardless, you should still hire an inspector. If they do lie, the law is on your side, but it’ll still be a huge hassle. If they don’t know, too, they can’t claim it, and they wouldn’t investigate anything that’s potentially a problem if they know they’re moving.
And caveat emptor? WTF. We have something known as "the rule of law". We’re civilized in this country.
